1.1 Welcome to Caravanek.com ("the Platform"), owned and operated by Motorhome Company Ltd., doing business as "Caravanek" ("Caravanek," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Platform and the services offered through it.

1.2 By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1.3 These Terms also incorporate our Privacy Policy, which outlines how we collect, use, and protect your personal information when you use the Platform. Please review our Privacy Policy carefully to understand our data practices.

1.4 The use of our services is subject to local laws and regulations in Saudi Arabia, and by using the Platform, you confirm that you will comply with all applicable laws and regulations.

1.5 These Terms constitute a legally binding agreement between you and Caravanek. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms, and "you" and "your" will refer to that entity.

1.6 Caravanek reserves the right to make changes to these Terms and will notify users of any significant changes through the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

3. Services

3.1 Caravanek provides an online platform, accessible through Caravanek.com ("the Platform"), that allows individuals and entities ("Hosts") to list their RVs, campgrounds, and resorts for rent, and users ("Guests") to browse, book, and pay for these accommodations.

3.2 Caravanek's services include:

   a. Providing a user-friendly website where Hosts can create listings, including detailed descriptions, photos, availability calendars, and pricing information.

   b. Offering search and booking functionality to Guests, allowing them to find suitable accommodations, check availability, and make reservations.

   c. Facilitating secure payment processing for bookings made on the Platform.

   d. Providing communication tools to enable Hosts and Guests to exchange messages, ask questions, and coordinate their stay.

3.3 It's important to note that Caravanek acts solely as an intermediary and does not own, operate, or manage the RVs, campgrounds, or resorts listed on the Platform. We do not provide accommodation services directly, and the contractual relationship for bookings is solely between Hosts and Guests.

3.4 While Caravanek strives to ensure the accuracy and quality of listings on the Platform, we do not guarantee the availability, quality, or safety of accommodations. Hosts are responsible for accurately representing their properties, and Guests are encouraged to review listings, ratings, and reviews before making bookings.

3.5 Caravanek may offer additional services or features in the future, such as RVs, campgrounds, resorts, accessories etc. They will be subject to these Terms and any specific terms and conditions provided at the time of the new service's introduction.

4. Host Responsibilities

4.1 Hosts, as individuals or entities listing their RVs, campgrounds, or resorts on Caravanek, have certain responsibilities:

   a. Accurate Listings: Hosts must provide accurate and comprehensive information about their accommodations, including but not limited to details about the property, pricing, availability,  rules, and any additional charges.

   b. Availability and Booking: Hosts must keep their availability calendars up to date to avoid double bookings. When a booking request is made, Hosts are expected to respond promptly, and if accepted, honor the reservation.

   c. Compliance with Local Laws: Hosts must comply with all local laws and regulations related to renting out their properties. This includes obtaining any necessary permits, licenses, or approvals required by authorities.

   d. Non-Discrimination: Hosts agree not to discriminate against Guests based on race, religion, nationality, gender, disability, sexual orientation, or any other protected characteristic under Saudi Arabian law.

4.2 Hosts are solely responsible for the content of their listings, and they should ensure that any photos, descriptions, and other information accurately represent the property they are offering.

4.3 Hosts should maintain open and respectful communication with Guests, promptly address any inquiries or concerns, and provide a welcoming and safe environment during their stay.

4.4 Caravanek reserves the right to remove or suspend listings that violate these responsibilities or our Terms and Conditions.

5. Guest Responsibilities

5.1 Guests who use Caravanek's Platform have certain responsibilities:

   a. Accurate Booking Information: Guests must provide accurate and complete information when making a reservation, including their name, contact details, and payment information.

   b. Compliance with Host Rules: Guests agree to comply with any specific rules, policies, or requirements set by the Host for their accommodation. This includes respecting check-in and check-out times, house rules, and any restrictions on the property.

   c. Respect for Property and Neighbors: Guests are expected to treat the rented property with care, keeping it clean and in the same condition as when they arrived. They should also be respectful of neighbors and the local community, refraining from disruptive behavior.

   d. Security and Safety: Guests should take appropriate precautions to ensure their own safety and the security of the property, including locking doors and windows when necessary.

5.2 Guests are encouraged to communicate openly with Hosts, asking questions and seeking clarification on any aspects of their stay. If any issues or concerns arise during their booking, Guests should contact the Host promptly for resolution.

5.3 It is essential for Guests to review and respect the Host's cancellation policy, which may vary depending on the property. Guests should be aware of the cancellation terms when making a reservation.

5.4 Caravanek reserves the right to take appropriate action, including account suspension, for Guests who fail to comply with their responsibilities or these Terms and Conditions.

6. Fees and Payments

6.1 Caravanek may charge fees for the use of its Platform and services, including booking fees and other applicable charges. Hosts and Guests will be informed of these fees before confirming a booking.

6.2 The fees collected by Caravanek are used to support the operation and maintenance of the Platform, including customer support and the development of new features.

6.3 Hosts are responsible for setting their own pricing for accommodations and should clearly communicate any additional charges or fees, such as security deposits or cleaning fees, in their listings.

6.4 Payments made through the Platform are processed securely. Hosts can choose their preferred payment method for receiving payouts, and Guests can make payments using the available payment options.

6.5 Hosts and Guests are responsible for any taxes or fees that may apply to their transactions, in accordance with Saudi Arabian tax laws.

6.6 Caravanek reserves the right to update its fee structure and payment policies, and any changes will be communicated to users in advance.

7. Cancellation Policy

7.1 Hosts on the Caravanek Platform have the flexibility to specify their own cancellation policies for bookings. These policies are set by the Host and apply to individual listings.

7.2 There are three cancellation policy options available:

   a. Strict Cancellation Policy:
- Full refund for cancellations prior to 30 days, less the Caravanek service fee.
- 50% refund for cancellations between 15 and 29 days, less the Caravanek service fee.
- No refund for cancellations within 0-14 days, less the Caravanek service fee.

   b. Standard Cancellation Policy:
- Full refund for cancellations prior to 30 days, less the Caravanek service fee.
- 25% refund for cancellations between 15 and 29 days, less the Caravanek service fee.
- 15% refund for cancellations between 14 and 3 days, less the Caravanek service fee.
- No refund for cancellations within 0-2 days, less the Caravanek service fee.

   c. Flexible Cancellation Policy:
- Full refund for cancellations prior to 30 days, less the Caravanek service fee.
- 50% refund for cancellations within 0-29 days, less the Caravanek service fee.

7.3 It's important to note that all refunds provided under the  cancellation policies are subject to deduction of the Caravanek service fee.

7.4 The specific cancellation policy for a booking will be clearly indicated on the booking page, and Guests should review it before making a reservation.

7.5 It is the responsibility of Guests to understand and accept the cancellation policy associated with their chosen accommodation before confirming a booking.

7.6 Hosts can choose the cancellation policy that best suits their preferences and the type of accommodation they offer.

7.7 Caravanek will facilitate the refund process in accordance with the applicable cancellation policy, but the timing and amount of the refund are determined by the policy in place at the time of booking.

7.8 Any disputes or disagreements related to cancellations should be addressed between the Host and Guest. Caravanek is not responsible for resolving such disputes but may provide information and documentation relevant to the booking or user conduct as required by applicable law.


8. Refund process

8.1 Caravanek will facilitate the refund process in accordance with the specified cancellation policy. Refunds will be processed as follows:

8.2 For cancellations that meet the criteria outlined in the chosen cancellation policy, Caravanek will initiate the refund process.

8.3 Refunds will be issued to the original payment method used for the booking.

8.4 Please allow approximately 7-14  business days for the refund to be reflected in your account. The actual processing time may vary depending on your financial institution.

8.5 Any applicable service fees or deductions will be clearly communicated as part of the refund process.

9. Insurance

9.1 Caravanek recommends that Hosts and Guests consider appropriate insurance coverage for their bookings. This may include insurance for RVs, campgrounds, resorts, and personal liability.

9.2 Hosts are encouraged to review their existing insurance policies to ensure they are adequately covered for renting out their properties or RVs. It is the responsibility of Hosts to understand the terms and conditions of their insurance coverage.

9.3 Guests should also consider travel insurance or other forms of coverage that may protect them in the event of cancellations, delays, or unforeseen circumstances during their stay.

9.4 Caravanek does not provide insurance coverage for Hosts or Guests and is not responsible for any insurance-related matters. Users should consult with their insurance providers to determine the most appropriate coverage for their needs.

9.5 Any agreements or arrangements related to insurance are solely between the users and their chosen insurance providers. Caravanek is not a party to such agreements and does not endorse or recommend specific insurance providers.

10. Privacy and Data Security

10.1 Caravanek takes the privacy and data security of its users seriously. We collect, use, and protect personal information in accordance with our Privacy Policy, which is an integral part of these Terms and can be found on the Platform.

10.2 By using the Platform, you acknowledge and consent to the collection and processing of your personal information as described in our Privacy Policy.

10.3 Caravanek employs industry-standard security measures to protect user data; however, no method of data transmission over the internet is entirely secure, and we cannot guarantee the absolute security of your data.

10.4 Users are responsible for maintaining the confidentiality of their account credentials and should not share them with unauthorized individuals. Caravanek will never request your password or financial information via email or unsolicited messages.

11. Prohibited Activities

11.1 Users of the Caravanek Platform are expected to conduct themselves in a responsible and respectful manner. Prohibited activities include but are not limited to:

   a. Illegal Activities: Users must not engage in any illegal activities while using the Platform. This includes violating Saudi Arabian laws and regulations.

   b. Harassment and Discrimination: Harassment, discrimination, or hate speech based on race, religion, nationality, gender, sexual orientation, or any other protected characteristic is strictly prohibited.

   c. Fraud and Misrepresentation: Users should not engage in fraudulent activities, including providing false information in their profiles or listings.

   d. Unauthorized Access: Unauthorized access to other users' accounts, data, or the Platform's systems is prohibited.

   e. Disruptive Behavior: Users must not engage in behavior that disrupts the normal operation of the Platform or interferes with the experience of other users.

11.2 Caravanek reserves the right to take appropriate action, including but not limited to suspending or terminating user accounts, for violations of these prohibited activities. We may also report illegal activities to the relevant authorities.

11.3 If you encounter any prohibited activities while using the Platform, please report them to us immediately.

12. Intellectual Property

12.1 Caravanek respects the intellectual property rights of its users and third parties. Users are expected to do the same and must not infringe upon the intellectual property rights of others while using the Platform.

12.2 Users retain ownership of the content they create and share on the Platform, including but not limited to listing descriptions, photos, and reviews.

12.3 By using Caravanek, users grant Caravanek a non-exclusive, worldwide, royalty-free
license to use, copy, modify, distribute, and publicly display their content for the purpose of operating and promoting the Platform.

12.4 Users may not use the Platform to upload, share, or distribute content that infringes upon the copyrights, trademarks, or other intellectual property rights of others. If you believe that your intellectual property rights have been violated by a user on the Platform, please contact us with the relevant information.

12.5 Caravanek will respond to notices of alleged copyright infringement and may take appropriate actions, including removing or disabling access to the infringing content.

13. Copyright

13.1 Unless otherwise indicated, all content and materials on the Caravanek Platform, including but not limited to text, graphics, logos, images, videos, and software, are the property of Caravanek RVs and Resorts Rental Company and are protected by copyright laws.
13.2 Users may not reproduce, distribute, modify, or create derivative works from any content or materials on the Platform without the prior written consent of Caravanek.
13.3 All rights not expressly granted in these Terms are reserved by Caravanek.

14. User-Generated Content

14.1 Caravanek allows users to create and share content on the Platform. Users are solely responsible for the content they create and share, including but not limited to listing descriptions, photos, reviews, and messages.

14.2 Caravanek does not endorse, control, or monitor user-generated content and is not responsible for the accuracy, legality, or appropriateness of such content.

14.3 Users acknowledge that Caravanek is not liable for any user-generated content and agree not to hold Caravanek responsible for any claims or disputes related to such content.

14.4 Users may not use the Platform to upload, share, or distribute content that infringes upon the copyrights, trademarks, or other intellectual property rights of others. If you believe that your intellectual property rights have been violated by a user on the Platform, please contact us with the relevant information.

14.5 Caravanek will respond to notices of alleged copyright infringement and may take appropriate actions, including removing or disabling access to the infringing content.

15. Termination

15.1 Caravanek reserves the right to suspend or terminate user accounts if users violate these Terms and Conditions or engage in prohibited activities as outlined in Section 8.

15.2 Termination may occur with or without notice, depending on the severity of the violation. For violations that warrant immediate action due to safety concerns or illegal activities, Caravanek may terminate an account without notice.

15.3 Users whose accounts are terminated may lose access to the Platform and any ongoing bookings or transactions. Any fees or payments associated with the terminated account may be forfeited.

16. Dispute Resolution

16.1 Caravanek is not responsible for resolving disputes between Hosts and Guests. Disputes that may arise during or after a booking, including issues related to refunds, property damage, or disagreements, should be resolved directly between the involved parties.

16.2 Users are encouraged to maintain open and respectful communication to resolve any issues. Caravanek may provide messaging tools to facilitate this communication.

16.3 In the event of a dispute that cannot be resolved amicably, users may explore legal remedies available under Saudi Arabian law. Caravanek does not provide legal advice or mediation services for disputes.

16.4 While Caravanek does not mediate disputes, we may assist with providing information and documentation relevant to the booking or the conduct of the users involved, as required by applicable law.

17. Liability

17.1 Users of the Caravanek Platform understand and agree that Caravanek is not a party to any rental agreements between Hosts and Guests. We act solely as a facilitator for bookings and payments.

17.2 Caravanek does not endorse or guarantee the accuracy, safety, quality, legality, or suitability of accommodations listed on the Platform. Hosts are solely responsible for the condition and safety of their properties.

17.3 Users acknowledge that any bookings made through the Platform are done at their own risk. Caravanek shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the Platform or any accommodations booked through it.

17.4 Caravanek does not accept liability for:

   a. Any loss or damage to property or belongings during a stay.
   b. Any injuries or accidents that occur during a stay.
   c. Any disputes or disagreements between users, including Hosts and Guests.

17.5 While Caravanek strives to provide a reliable and secure platform, we cannot guarantee the continuous availability or uninterrupted operation of the Platform. Users should use the Platform with awareness of its inherent risks.

18. Changes to Terms

18.1 Caravanek may update and modify these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or for other reasons.

18.2 Users will be notified of any significant changes to these Terms through the Platform. It is the responsibility of users to review and familiarize themselves with the updated Terms.

18.3 By continuing to use the Platform after changes to the Terms have been posted, users indicate their acceptance of the updated Terms.

18.4 If users do not agree with the revised Terms, they should discontinue their use of the Platform.

19. Governing Law

19.1 These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

19.2 Any disputes arising from the use of the Caravanek Platform or related services shall be subject to the exclusive jurisdiction of the courts in Saudi Arabia.

19.3 Users of the Platform agree to submit to the jurisdiction of Saudi Arabian courts and waive any objections to the exercise of jurisdiction over them by such courts.
